These Terms of Use (“Terms”) govern your use of https://swordthepoet.com (the “Site), operated by Sword (“Sword,” “we,” “us,” or “our”). “Sword the Poet” is a social media handle and is not a separate operator.

By using the Site, you agree to these Terms and to our Privacy Policy at https://swordthepoet.com/privacy. If you do not agree, do not use the Site.

  1. The Site

The Site is a poetry brochure for Sword: selected stanzas, fragments, and recorded readings, plus a way to inquire about commissions and readings. The Site does not offer accounts, checkout, or a mailing list. An inquiry is not a booking or a contract until Sword confirms it in a separate writing.

  1. Intellectual property

Poems, recordings, text, images, and other content on the Site are owned by Sword or used with permission. You may view the Site for personal, non-commercial use. You may not copy, republish, perform, record, train models on, or commercially use the content without Sword’s prior written permission, except for a short quotation with credit where fair use allows.

Site name, look, and layout are also protected. Do not suggest you are Sword or speak for Sword.

  1. Acceptable use

You agree not to:

  • Break the law or these Terms while using the Site

  • - Scrape, harvest, or overload the Site

  • - Try to access non-public areas or interfere with security

  • - Post or send unlawful, infringing, or abusive material

  • - Use the Site to collect other people’s information

  1. Inquiries

If you email swordthepoet@proton.me or use a form we add later, you are responsible for what you send. Do not send confidential material you are not ready to share. We may decline any commission or reading request.

  1. Third-party links

The Site may link to other sites or platforms (including social accounts). Those sites have their own terms. We are not responsible for them.

  1. Disclaimer

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.

  1. Limitation of liability

To the fullest extent allowed by law, Sword is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site. The Site is free. Our total liability for a claim related to the Site will not exceed one hundred U.S. dollars (US $100).

Some places do not allow these limits. In those places, our liability is limited to the maximum the law allows.

  1. Indemnity

You will defend and hold harmless Sword from claims, damages, and reasonable costs arising from your misuse of the Site, your content you send us, or your breach of these Terms, to the extent allowed by law.

  1. Privacy

Our Privacy Policy at https://swordthepoet.com/privacy explains how we handle information. These Terms do not replace that Policy.

  1. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms.

  1. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts in California have exclusive venue for disputes arising out of these Terms or the Site, except where a law that cannot be waived says otherwise.
